المقاصد الشرعية تعتبر دليلا من أدلة التأويل، أو قرينة من القرائن المرجحة للاحتمال الذي في اللفظ الظاهر، وهو ما يعرف بالتأويل المقاصدي الذي تُلتمس فيه المعاني الحقيقية للنصوص ويُجتنب فيه المعنى الحرفي دون الخروج عن وضع اللغة أو عُرف الاستعمال أو عادة الشرع، مع كونه منضبطًا بضوابط التأويل الصحيح صادرًا ممن هو أهلٌ لذلك وعلى دراية كافية بمنهج التعليل القائم على استجلاء الحِكم التشريعية التي قصدها الشارع من خلال نصوص القرآن الكريم والسنة النبوية المطهرة كونهما الميزان الدقيق لضبط الطريق الذي تسير عليه المقاصد، فلا يجوز أن يُستمد منها ما يبطلها أو يلغيها، على أن تكون الحكمة التشريعية من القوة ما يجعلها قادرة على صرف الظاهر وتأويله. 
Legislative objectives are considered evidence of interpretation, or evidence that indicates the possibility in the apparent word. This is what is known as intentional interpretation in which the true meanings of texts are sought and the literal meaning is avoided without deviating from the situation of the language, the traditional usage, or the custom of legislation, while being controlled by the rules of correct interpretations. The correct interpretation comes from someone who is qualified to do so and has sufficient knowledge of the method of reasoning based on clarifying the legislative rulings intended by the legislator through the texts of the Holy Qur’an and the purified Sunnah of the Prophet, since they are the accurate scale for controlling the path on which the objectives are moving. It is not permissible to derive from them anything that invalidates or cancels them, provided that Legislative wisdom is so powerful that it is capable of dismissing the apparent and interpreting it.
